My understanding is Kelley let his guard down since he thought the approaching car carried his fellow officers who had been checking in with him periodicaly throughout the night via automobile. By the time he recognized his quarry the game was up.

Erv Kelly was a "Special Agent" for the Oklahoma Bankers Assoc. Was this a law enforcement position? What I want to know is, was Erv Kelly a law enforcement officer when he was killed?

Kelley was a Special Investigator for the Ok Bankers Ass. at the time of his death. If he had any special police powers or was actually a bonified peace officer at the time is beyond me.I think lines were a bit blurred back in those days. I always assumed he was deputized when he joined the Bixby posse. Kelley had previously served as the McIntosh Co. Sheriff and with the Checotah PD.

My aunties were very good friends with him and were the first to know he was dead because they were in a car behind him. My mom met him and served him beer at my uncles house. She is 93 and said he was nice. My aunties wept when he was killed. Turtle
