John Harris and John Griffith had a gunfight, at a barber shop in Poteau Choctaw Nation about 1890. John Griffith was killed and John Harris was shot 3 times, but survived to be tried by Judge Parker for murder. John Harris' lawyers were successful in getting the charges reduced to manslaughter. The lawyers argued that John Griffith used tobacco and drank liquor for several years and underminded his health before he stopped the bullet. They argued that an abstainer would have been in better health and would have a better chance of pulling through after being shot. Fortunately for me, I am John Harris' grandson, the jury agreed and called it manslaughter and John Harris only got about 5 years at the Detroit House of Corrections.
