Connie,

There was a deputy US marshal named Tom Smith from Texas who was killed in Indian Territory. His son Frank Smith became an FBI agent who was a famous lawman. Could this be who you are asking about?
Cool

Jay Nash's Encyclopedia of Western Lawmen lists a Tom Smith who was born in Texas and "became a law enforcement officer in Texas and Oklahoma. He also served as a deputy U. S. marshal in the 1870s." He was reportedly killed in 1893 in Gainesville, TX while riding a train. Nash also lists another Thomas Smith (AKA Bear River Smith) but as he died in 1870 it is unlikely he's the person you're interested in.
